Creator Agreement
Effective Date: January 8, 2026
This Creator Agreement ("Agreement") is entered into between Streamtunes ("Platform," "we," "us," or "our") and the individual or entity registering as a creator ("Creator," "you," or "your").
By uploading content or receiving payouts through the Platform, you agree to the terms below.
1. Platform Description
The Platform is a subscription-based music streaming service. Users pay the Platform for access to stream music. Creators are compensated via royalty payouts based on streaming activity.
Creators are not sellers, not merchants of record, and do not transact directly with end users.
2. Eligibility and Account Setup
To participate as a Creator, you must:
- Be at least 18 years old
- Have a valid PayPal account in good standing that can receive payments
- Complete tax form onboarding through our designated tax accounting service
- Provide accurate tax and identity information
- Maintain an active payout-enabled PayPal account
2.1 PayPal Account Requirements
To receive royalty payouts, you must have a valid PayPal account. You may use either a personal or business PayPal account. During the creator onboarding process, you will be asked to:
- Provide the email address associated with your PayPal account
- Affirm that you have a valid PayPal account in good standing
Important: You are solely responsible for ensuring that your PayPal account is valid, active, and able to receive payments. The Platform does not verify your PayPal account status and is not responsible for:
- Failed payouts due to an invalid, suspended, or limited PayPal account
- Payouts sent to an incorrect email address that you provided
- Any issues with your PayPal account that prevent you from receiving or accessing funds
- PayPal's fees, policies, or account limitations
If a royalty payout fails due to issues with your PayPal account, the Platform is not obligated to recover or re-send the failed payment. You may contact support to update your PayPal email address for future payouts.
2.2 Tax Form Onboarding
As part of the creator onboarding process, you will be required to complete tax form onboarding through our designated tax accounting service. This process includes:
- Receiving an email from our Platform notifying you of the tax form requirement
- Receiving a separate email from our tax accounting service provider with a secure link
- Completing the appropriate tax form (W-9 for U.S. persons or W-8 for non-U.S. persons)
- Submitting accurate and complete tax information
You must complete the appropriate tax form before you can be fully onboarded as a Creator and begin receiving royalty payouts.
Failure to complete onboarding may result in delayed or withheld payouts.
3. Ownership and License Grant
You represent and warrant that:
- You own or control all necessary rights to the content you upload
- Your content does not infringe any third-party rights
You retain full ownership of your content.
You grant the Platform a non-exclusive, worldwide, royalty-free license to:
- Host
- Stream
- Cache
- Display
- Transmit
your content solely for the operation and promotion of the Platform.
4. Royalties and Payouts
4.1 Royalty Calculation
Royalties are calculated based on qualifying streams, defined as continuous playback of at least 30 seconds.
The current royalty rate is published on the Platform and may be updated at our discretion.
4.2 Payment Timing
- Royalties are accrued internally
- Payouts are issued on a weekly basis
- Minimum payout thresholds may apply
5. Taxes
Creators are independent contractors.
5.1 Tax Withholding
- U.S. Creators: We generally do not withhold taxes from your royalty payouts unless you are subject to backup withholding. If you indicate on your W-9 form that you are subject to backup withholding, we will withhold 24% of your gross payments as required by IRS regulations. You are responsible for reporting your income and paying any applicable taxes.
- Foreign (Non-U.S.) Creators: We may withhold taxes as required by U.S. law. The withholding rate depends on your country of tax residence and any applicable tax treaty benefits you claim on your W-8 form. The default withholding rate is 30%, but may be reduced if a tax treaty applies.
5.2 Tax Forms
As part of the creator onboarding process, you are required to complete the appropriate tax form through our designated tax accounting service:
- U.S. Persons: You will complete IRS Form W-9 (Request for Taxpayer Identification Number and Certification). If you are subject to backup withholding, please indicate this on your W-9 form.
- Non-U.S. Persons: You will complete the appropriate IRS Form W-8 (such as W-8BEN or W-8BEN-E)
Your tax information is securely collected and stored by our designated tax accounting service provider.
5.3 Tax Reporting
Based on your tax status and earnings, you may receive the following tax documents:
- Form 1099-NEC: Issued to U.S. persons who meet IRS reporting thresholds (gross amount in Box 1, any backup withholding in Box 4)
- Form 1042-S: Issued to non-U.S. persons for reporting income subject to withholding
Tax forms will be issued in accordance with applicable IRS requirements and deadlines.
The Platform may suspend payouts if required tax information is not provided.
6. Content Standards and Enforcement
You agree not to upload content that:
- Infringes copyrights or trademarks
- Is unlawful, deceptive, or fraudulent
- Contains malware or malicious code
We reserve the right to remove content or suspend accounts at our sole discretion.
6.1 Content Disabling
The Platform reserves the right to disable any content (songs, tracks, or other media) at its sole discretion for any reason, including but not limited to:
- Copyright or trademark infringement claims
- Violation of content standards or Platform policies
- Legal, regulatory, or compliance concerns
- Quality control or technical issues
- Complaints from users or third parties
6.2 Effects of Content Disabling
When content is disabled by the Platform:
- The content will no longer appear in the media library
- The content will be automatically removed from all user playlists, including auto-generated and user-created playlists
- The content cannot be played or streamed on the Platform
- The content cannot be added to new playlists
- You will not earn royalties for streams while the content is disabled
Disabled content will still appear in your Creator Dashboard with a "Disabled" status indicator, along with the reason for disabling. However, you will not be able to edit or modify disabled content.
6.3 Notification and Appeals
When content is disabled, you will receive an email notification that includes:
- The title of the disabled content
- The reason for disabling
- Information about the appeal process
If you believe your content was disabled in error or wish to discuss the decision, you may contact our customer service team at customerservice@streamtunes.net.
6.4 Re-Enabling Content
The Platform may, at its sole discretion, re-enable previously disabled content if:
- The issues that led to disabling have been resolved
- A successful appeal has been processed
- Legal or compliance concerns have been addressed
When content is re-enabled, you will receive an email notification. Re-enabled content will again appear in the media library and be available for streaming and playlists.
7. DMCA Compliance Policy
The Platform complies with the Digital Millennium Copyright Act (DMCA).
7.1 Copyright Complaints
If you believe content infringes your copyright, send a written notice including:
- Your contact information
- Identification of the copyrighted work
- Identification of the infringing content
- A statement of good-faith belief
- A statement under penalty of perjury
- Your physical or electronic signature

7.2 Counter-Notification
If your content is removed due to a DMCA notice, you may submit a counter-notification as permitted by law.
8. Refund Policy
Subscription payments are non-refundable. The Platform does not offer refunds for subscription payments.
Royalty payouts to Creators are final once issued.
9. Suspension and Termination
We may suspend or terminate your account if:
- You violate this Agreement
- You fail identity or tax verification
- Your content creates legal or compliance risk
Upon termination:
- Outstanding accrued royalties may be paid
- Content licenses terminate
- Access is revoked
10. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is not liable for lost profits
- Liability is limited to royalties paid in the preceding 12 months
11. Indemnification
You agree to indemnify and hold harmless the Platform from claims arising from:
- Uploaded content
- Breach of this Agreement
- Intellectual property violations
12. Governing Law
This Agreement is governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
13. Privacy Note (Creator-Specific)
Creator payout and tax information is handled securely by our payment processor. The Platform does not store full tax identification numbers.
14. Changes
We may update this Agreement. Continued participation constitutes acceptance of changes.
